From three to six months in prison
Three to six months in prison. Article 379.2, read with 379.1, provides alternatives of three to six months’ imprisonment, a fine of six to twelve months or thirty-one to ninety days of community service; in every case it also provides disqualification from driving motor vehicles and mopeds for more than one year and up to four years. This does not mean imprisonment is always imposed. The offence requires driving under the influence of those substances; mere drug presence and the administrative offence are different situations.
