Where no exemption applies, both must wear a properly fastened protective helmet. Article 118.1.a requires UNECE R22 approval, but the first transitional provision of RD 518/2026 allows certified moped helmets to continue being used for one year from 1 October 2026. Therefore, in October 2026 a certified helmet admitted under that regime is not prohibited solely for lacking type approval. The protective-structure and seat-belt exemption requires confirmation in technical documentation and use of the belt. Gloves, a vest or a cap do not replace a helmet.
