BDifficulty 2/5

A driver commits an offence involving the presence of drugs and officers immobilise the vehicle for that reason. It was not stolen or used against the keeper’s wishes. As the initial rule, who must pay the immobilisation costs?

Correct answer

The driver who committed the offence.

The driver who committed the offence, under Traffic Law article 104.6. Failing that, the habitual driver or lessee, and then the keeper, are provided for. Article 104.1.d permits immobilisation following refusal of testing or a positive result; it should not be described as invariably automatic or confuse alcohol limits with drug presence. Appeal rights and other legal conditions remain applicable.
